Implementasi Perlindungan Hak Istri Pasca Perceraian dalam Praktik Peradilan Agama
Abstract
Penelitian ini bertujuan untuk menggambarkan implementasi perlindungan hak istri pasca perceraian dalam praktik peradilan agama di Indonesia. Penelitian ini menggunakan metode deskriptif kualitatif dengan pendekatan yuridis normatif dan empiris. Data dikumpulkan melalui studi putusan pengadilan agama, peraturan perundang-undangan, serta literatur hukum yang relevan. Hasil penelitian menunjukkan bahwa pengadilan agama telah memberikan perlindungan hukum terhadap hak istri pasca perceraian melalui putusan hakim yang mengatur nafkah iddah, mut’ah, nafkah anak, dan pembagian harta bersama. Namun, dalam praktiknya, pelaksanaan putusan tersebut masih menghadapi berbagai kendala, seperti ketidakpatuhan mantan suami dan lemahnya mekanisme eksekusi. Oleh karena itu, diperlukan penguatan perlindungan hukum agar hak istri pasca perceraian dapat terpenuhi secara efektif dan berkeadilan
